ORANGE, Mass. (WWLP) – The man and woman charged in a home invasion murder in the Franklin County town of Orange are expected to be back in Massachusetts and in court by Friday.

Joshua Hart and Brittany Smith were arraigned in a Virginia courtroom Tuesday afternoon, three days after their capture in the parking lot of a Walmart in Lexington, VA. They are accused of murdering 95 year-old Thomas Harty and severely injuring Harty’s wife, Joanna Fisher, after breaking into their East River Street home last week.

The two allegedly made a getaway in the couple’s Toyota Corolla wagon, and continued to commit crimes while on the run. They are accused of committing a robbery at a mall in Harrisonburg, Virginia two days after Harty’s murder.

Hart and Smith waived rendition during their arraignment on fugitive from justice charges in Rockbridge County, Virginia Tuesday. They are scheduled for arraignment on charges of murder, attempted murder, home invasion, and robbery at Orange District Court late Friday morning.
