WEST SPRINGFIELD, Mass. (WWLP) – On Monday, 22News first told you that the contractor working on the Memorial Avenue Rotary project might not get penalized for missing the completion deadline because of a contract loophole.
On Friday, we brought our concerns to the Massachusetts Department of Transportation.
The contractor, SPS New England, hasn’t finished the project and the deadline was on November 28th. The company filed for an extension, saying they were asked to do more work than originally outlined.
MassDOT Secretary & CEO Stephanie Pollack said they’ll decide if that’s true, and told us exactly what hasn’t been done yet. She said, “If we don’t accept justification, we are still in a position to make sure their penalized. It’s all landscaping and sidewalks, but the jobs not done until it’s done and we need to get that all wrapped up.”
The company is facing a $90,000 penalty, which they have appealed.
