SPRINGFIELD, Mass. (WWLP) – A mom in Springfield is suing school department leaders claiming they failed to protect her daughter.
The 22News I-Team obtained court papers that allege a girl was sexually assaulted on the playground at Duggan Middle School by another student.
According to the legal complaint, that student was suspended and placed in another classroom later that school year. However, the following year he was once again placed in the girls classroom, where he repeatedly threatened the girl and pressured her into having sex with him during school hours.
The school department wants the case thrown out claiming they took necessary steps to protect the student. U.S. District court Judge Mark Mastroianni is hearing the case and is expected to rule on it in a few weeks.
