Charles Wilhite was convicted of first degree murder in 2010

SPRINGFIELD, Mass. (WWLP) – Charles Wilhite has filed a lawsuit against the state, claiming he spent 40 months in jail for a murder he did not commit.

Wilhite was convicted of first degree murder in 2010. Two years later, a Hampden Superior Court judge ordered a new trial after a witness recanted their testimony.

Wilhite was found not guilty at his murder re-trial and set free in January 2013.

He is seeking $500,000 in damages. He has also filed a federal civil rights complaint against two Springfield police officers and the city.
